1. Introduction
Welcome to Bhumija Holidays. These Terms and Conditions govern your use of our services, including our website (bhumijaholidays.com) and all travel services we provide. By booking a trip or using our services, you agree to be bound by these terms.
Bhumija Holidays is a registered travel handling company based in Kathmandu, Nepal, specializing in cultural and heritage tourism within Nepal.
2. Booking and Confirmation
2.1 Booking Process
- All bookings are subject to availability and confirmation from Bhumija Holidays.
- A booking is considered confirmed only after we have received the required deposit and sent you a written confirmation.
- The person making the booking ("lead traveler") must be at least 18 years of age and is responsible for ensuring all travelers in the group comply with these terms.
2.2 Deposit and Payment
- A deposit of 30% of the total package cost is required at the time of booking.
- Full payment must be received at least 30 days before the departure date.
- Bookings made within 30 days of departure require full payment at the time of booking.
- We accept payment via bank transfer, credit card, and major international payment platforms.
2.3 Pricing
- All prices are quoted in Nepalese Rupees (NPR) unless otherwise stated.
- Prices are subject to change due to currency fluctuations, fuel surcharges, or changes in government taxes until full payment is received.
- Once full payment is received, your price is guaranteed except for government-imposed taxes or charges implemented after booking.
3. Cancellation Policy
3.1 Cancellation by Traveler
- Cancellations must be made in writing via email to info@bhumijaholidays.com.
- Cancellation charges apply as follows:
- 30+ days before departure: Full refund minus 5% processing fee
- 15-29 days before departure: 50% refund
- 7-14 days before departure: 25% refund
- Less than 7 days before departure: No refund
- No-shows are non-refundable.
3.2 Cancellation by Bhumija Holidays
- We reserve the right to cancel any trip due to insufficient bookings, safety concerns, natural disasters, or circumstances beyond our control.
- In such cases, travelers will receive a full refund or the option to transfer their booking to an alternative date.
- We are not liable for any additional expenses incurred by travelers due to such cancellations (e.g., airfare, visa fees).
4. Changes to Bookings
4.1 Changes by Traveler
- Requests for changes must be made in writing at least 14 days before departure.
- Changes are subject to availability and may incur additional charges.
- Name changes may be permitted up to 14 days before departure, subject to supplier conditions.
4.2 Changes by Bhumija Holidays
- We reserve the right to make minor changes to itineraries when necessary for operational reasons, safety, or unforeseen circumstances.
- In case of significant changes, we will notify you as soon as possible and offer alternatives where available.
- Significant changes include: change of destination, substantial change in accommodation standard, or itinerary modifications affecting more than 50% of included activities.
5. Travel Documents and Health Requirements
5.1 Passports and Visas
- Travelers are responsible for ensuring they have valid passports (minimum 6 months validity) and appropriate visas for Nepal.
- Most nationalities can obtain a visa on arrival at Tribhuvan International Airport. Please verify current requirements before travel.
- Indian nationals do not require a visa for Nepal.
5.2 Health and Vaccinations
- Travelers are responsible for obtaining necessary vaccinations and health documentation.
- We recommend consulting a healthcare provider regarding recommended vaccinations for Nepal.
- Please inform us of any medical conditions that may affect your ability to participate in activities.
6. Insurance
6.1 Travel Insurance Requirement
- Comprehensive travel insurance covering medical expenses, trip cancellation, personal accident, and baggage loss is strongly recommended.
- Bhumija Holidays is not responsible for any losses, costs, or expenses arising from incidents that would be covered by adequate travel insurance.
7. Liability
7.1 Our Liability
- Bhumija Holidays acts as an intermediary between travelers and service providers (hotels, transport, guides, etc.).
- We are not liable for any injury, illness, death, loss, damage, or irregularity caused by the negligence of third-party suppliers.
- Our liability is limited to proven direct damages resulting from our negligence and shall not exceed the total amount paid for services.
7.2 Force Majeure
- We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemic, war, civil unrest, strikes, government actions, or severe weather conditions.
8. Conduct and Behavior
8.1 Traveler Conduct
- Travelers must comply with local laws and customs.
- Respectful behavior at religious and cultural sites is mandatory.
- We reserve the right to terminate the trip of any traveler whose behavior is disruptive or endangers others, without refund.
8.2 Cultural Sensitivity
- Nepal is a culturally diverse country. We expect travelers to respect local customs, dress modestly at religious sites, and follow guide instructions.
9. Complaints and Disputes
9.1 Complaints Procedure
- Any complaints during your trip should be reported immediately to your guide or our local representative.
- Written complaints should be submitted within 28 days of return to info@bhumijaholidays.com.
- We will acknowledge receipt within 48 hours and respond fully within 28 days.
9.2 Governing Law
- These terms are governed by the laws of Nepal.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
10. Privacy and Data Protection
Your personal information is collected and processed in accordance with our Privacy Policy. By booking with us, you consent to our use of your data as described in that policy.
